Effective: April 28, 2026
1. Statement of Compliance
All persons whose images appear in any listing, photograph, or other visual depiction on SkipTheGames were at least 18 years of age at the time the visual depiction was created. SkipTheGames takes the age threshold extremely seriously and reports any credible suspicion of underage content to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
2. SkipTheGames Is a Directory, Not a Producer
SkipTheGames is an online directory of user-submitted classified-style listings. The site does not produce, create, edit, manipulate, or otherwise generate the photographs or other visual content that appears in user listings. All such content is submitted by independent third parties (the "Posters") who retain sole ownership of their material and are responsible for their own compliance with all applicable laws.
Under 18 U.S.C. § 2257 and the implementing regulations at 28 C.F.R. Part 75, SkipTheGames qualifies as a service provider under 47 U.S.C. § 230 and not as a primary or secondary "producer" of any visual depiction of actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2)(A).
3. Exemption Notice
To the extent any visual depiction on SkipTheGames falls within the scope of 18 U.S.C. § 2257, SkipTheGames relies on the exemption set forth in 28 C.F.R. § 75.7 for content that does not depict actual sexually explicit conduct as defined in the statute. The vast majority of visual content displayed on the site consists of self-shot profile-style photographs that do not meet the statutory definition.
4. Records of Original Producers
For any content on SkipTheGames that does fall within the scope of 18 U.S.C. § 2257, the records required by that statute and 28 C.F.R. § 75 are maintained by the original producer(s) of such content — that is, the individual third-party Poster who created and submitted it. SkipTheGames does not produce, host (in the statutory sense), or otherwise create such content, and therefore does not maintain those records on the original producer's behalf.
Posters acknowledge — when submitting a listing — that they are solely responsible for compliance with 18 U.S.C. § 2257, 18 U.S.C. § 2257A, and 28 C.F.R. § 75 with respect to any content they submit, and they represent that all individuals depicted in their submissions were at least 18 years of age at the time the content was created.
